I believe ...I had my hearing with the alj 2wks ago. I believe it went well. He gave me a chance to submit other medical notes he didn't recieved from the doctors and hospital. I explained my situation and the alj noticed on my medical notes I had been getting sick due to recurring UTI after kidney transplant and admitted to the hospital for 4-5 days with IV antibiotics. For the past year I have been sick 4 times with IV antibiotics again because of fevers and chills I get. On January of this year I was sick again given antibiotic pills. <br />After I have stated what the doctor said about my condition of being on immunosuppressant, can't be outside too long, can't be around a lot of people, and constantly having to use the bathroom a lot during the day and it doesn't include waking up at night;and after explaining this to VE, the alj said I have 2% chance of going back to work? Also, the alj asked if this is the only income I received. Is this normal for hI'm to ask?<br /><br />What is my chance of getting a favorable decision? I was denied because they said I did not have enough credits. Then the credits were approved and I saw a different judge for the medical determination along with again the credit review. He approved me for the credit but denied me from the medical. The Vocational experts that was there said I was not able to do light, skilled work that I've done in the past as a real estate agent and as a hostess. Which I was a restaurant manager that I had to do several other things other than just hosting to say the least he told me I was not able to do either one of those jobs. He did at the end list three jobs that were a telephone quotation Clerk, a document preparer, and an assembler. Looking up all three of those under the guidelines they were just like the job I used to do. Except for the assembler which was something that I cannot do do to my lower back surgery, herniated disc, no overhead reaching, osteoarthritis, bone degenerative disease, and the list goes on and on. How can they say that I cannot do light, skilled work but I am able to do those other three? I know this blog exist for a multitude of reason but we are all looking for some sort of assurance thing's will go in our favor and there is simply no other way to say that. Just like there is no way of googling the answer we want to see!<br /><br />So my break down is very very simple. I applied for for Social Security on 1/20/15 and was denied on 3/5/15 (1st). Appealed and was denied again some time in July (2nd). Finally requested a hearing on 7/17/15. Today is 1/6/17 and I have finally seen the judge! I had no idea of any VE until today (ironic) and googled away like the rest of the world. Search: "The VE response was no to 2 out of 3 of the hypothetical questions" But. As I read I see there have been others with a "No" across the board and still lost. So I can't tell you anything more than I am gonna hope for the best. <br /><br />Of course I will come back and let everyone know the outcome. Just like the rest sometime in the next 90 day's. I am here to inform people of the first question I was asked. I have been labeled ADD/ADHD & Bipolar. But the one listed and mentioned in my hearing was ADD! Which is why I am writing. That first question. My first question was: "That cup was it already there or did the previous person leave it and you started to use it"? I thought nothing of it at the time. But when family and I talked on my hearing it hit me! Was this a trick question? I told the judge I think it was new and I poured the water into it. Within 60 seconds I interrupted the judged as we moved forward and said " You know what now that you mention I do not remember if the cup was already here or if I just grabbed it. So let me move it and get a new one since you have mentioned it". And the hearing started. Or had it already? <br /><br />I truly don't recall if the cup was already used or did I get a new one? I do recall pouring the water but that was all. I wouldn't even be here writing it but after speaking to family it reminded me of the Matrix (don't worry about the vase). Simply put I have no idea if the judge was concerned or if the whole scenario was staged. I also gave no thought to it being a trick question or a part of the hearing and simply moved forward. <br /><br />That's it guy's. That was my hearing, I had just proved ADD in the first 3 minutes of me sitting down. Anxiety, loud outburst and impulsive behavior were present too. l was being myself! I hope my honesty was heard by the judge, this entire thing is driving me more insane and hard to coupe. When I asked my attorney what her thought's were on the hearing she replied: "Well the VE said no to 2 out of 3 hypothetical question's but the hard part is done". Which is when it hit me what and who that person was in the room (the VE). Even though it was already explained at the hearing introduction. Prompting google searches on what "IF'S" of the VE. <br /><br />We are not going to find the answers on google. I hope everyone who truly needs help get's it! As for the lazy one's... Thank's so much for making it harder for us! I am as nervous and scared as the rest of you I need this help more than I can express and I refuse to google anymore until I receive my decision in the mail. You all should the same right now. I said no. The ALJ was nice and asked helpful questions. The VE was there. Everyone was sworn in. I gave my testimony. The ALJ did NOT ask the VE ANYTHING at all. So my big question is that a good thing? Is it really promising that I could be approved? After the session was closed the VE told me that because she didn't ask me anything that it was a really good sign. I just had my first ssdi hearing in front of ...Hi, <br />I just had my first ssdi hearing in front of an ALJ. I'm 49 years old, have applied and appealed my case 2 years previously, so total I've been chasing my ssdi claim for 4 1/2 years. <br /><br />I have vertigo, hearing loss, and tinittus in my left ear. Balance problems walking, and going up and down steps. I have a damaged right arm with 60% strength lost compared to my left (and I'm right handed dominate) due to a workers comp claim that finalized in 2013 which I got pennies on the dollar for. <br /><br />I also have severe depression, anxiety and stress. My therapist has said in their reports that she refuses me to try working due to my depression issues and such, and has told me for the past 2 years as it would be too much stress and anxiety for me. <br /><br />I used to be a truck driver until 2012, and my illnesses started, and I had to give up my cdl license. I don't drive much at all now due to my vertigo symptoms and I'm a large fall risk. can't sit for more than 2-4 hours and my medications make me sleepy during the day. My asthma and bronchitis has given me a coughing and blackout reactions to humidity or dirt dust areas, and I get dizzy if I turn my head too fast. <br /><br />My case was going well and the judge was attentive, but when the VE started saying the jobs that were available was security work, Hostess Event worker or something, or department sales... saying millions of jobs were available as sedentary work, part or full time. <br /><br />Judge didn't let my attorney cross the VE and my attorney argued something about old list numbers and the judge got angry after back and forth and threw my attorney out after attorney said being unable to cross the VE would risk her job. <br /><br />However, five minutes later, Judge called us back in and said his next 2 cases were no shows and we could cross the ve. However the VE said there were millions of sales jobs and security jobs were still out there. But Sedentary work. <br /><br />can't the medical and mental evidence by my doctors outweigh the VE saying I can get. Any sales jobs when I have hearing loss, walk with a cane, a fall and injury risk, and only drive with my wife with me in the car?<br /><br />I thought VEs could only offer jobs that match what I was experienced with that fit my profile, and that were 'needed gainful employment' by the judges orders. <br /><br />Was the judge trying to get me to react badly when he threw us out of his court, and deny my case? all I did was sit there stunned and not reply. Only after a few minutes did he have us return and start again. <br /><br />Now the judge asked for a follow up neurologist of his choosing to see me, and I will counter with my own.<br /><br />Also the judge did do the hypotheticals and my having more than 4 days a month out would wipe out my past job experiences, and only thing available is light security work, looking at a screen, and sales, which I never did, or cashier.<br /><br />I'm very confused why the judge acted this way and asked if I had any questions. I stated I was confused why we were arguing about different jobs and where these job listings were found. Statement says "The AC vacates the hearing decision and remands this case to ALJ for resolution " and it lists the issues. The end of the letter states " ALJ will offer claimant opportunity for a hearing, take further action needed to complete the admn record and issue a new decision. I was 50 with VE saying I could perform "sedentary work".
